1. No specific policies or law for tenancies

Unlike the procedure of sales and purchase of agreement under the Housing Development (Control and Licensing) Act 1966 that people get when they purchase a house, there is no specific policies for tenancies. Tenancy refers to the agreement on rental period that is lesser than 3 years. It is important to note that there is no specific tenancy act available in Malaysia, nor do they have any legal framework regarding tenancies. That being said, Malaysia is practicing pro-tenant when it comes to tenancies. Therefore, the landlord will just have to accept this fact and be prepared for a disadvantage. 

2. Importance of tenancy agreement

As mentioned above, currently there is no law that governs tenancies in Malaysia, hence the importance of tenancy agreement. The tenancy agreement is a document between the landlord and tenant with agreed terms and conditions between both parties. However, do note that the tenancy agreement is just an agreement that is under the Contracts Act, where it is assumed that all parties have agreed to the mutual agreement regarding the terms and conditions on their own will. Therefore, it is really important to read thoroughly the tenancy agreement before the landlord signs the tenancy agreement. The question is, how many of us do actually read through all the terms and conditions stated in the tenancy agreement as most agreement are few pages long? Understanding the tenancy agreement is essential as it will allow both parties to voice out any disagreement and make amendments to it before it is too late. Do not hesitate to call for a meeting between the landlord and tenants if there is any disagreement. If not, you could also call for legal assistance to seek for professional advice in the tenancy agreement so both parties will get benefits out of it without compromising each other’s benefits. 

Some of the terms that you will need to carefully look out for are:
a. Tenancy period + option to renew
b. Rental + deposit
c. Good and Service Tax (If applicable)
d. Mode of payment
e. Details of tenant and landlord
f. Tenancy purpose
g. Obligations and covenants
h. Commencement date + yield up date
i. List of fittings and fixtures
j. Special conditions

3. Difference between commercial tenancies and residential tenancies

As there is no standard tenancy agreement, commercial tenancies are generally more complicated than residential tenancies. Commercial tenancies have more obligations on tenants as compared to residential tenancies in terms of business licences, renovations, miscellaneous fees and GST. Hence, the major difference between a commercial tenancy and a residential tenancy. 

4. Legal remedies

In the event of any dispute between the tenant and landlord, the landlord will usually be at the losing end, such as late rental payment, tenant’s refusal to vacate, or overstays. In such cases, the only thing the landlord could do is to go for legal remedies, such as the distress action that is under the Distress Act 1951. Other than the Distress Act 1951, the landlord could also go for the Eviction Order under the Specific Relief Act 1950. 

However, do bear in mind that the landlord will have to obtain a court order before the landlord could recover the possession of the property from his or her tenant. 

If not, the landlord could try on some self help measures that might work, such as:
a. Lodge police report
b. Break the lock under police supervision
c. Take photos as evidence in case the tenants claim any loss of belongings
d. Place a notice
e. Place the photocopy of police report along with the notice 

Of course, all these are the final resort that you would want to do. Therefore, it is always important to read the tenancy agreement carefully before signing it to prevent getting yourself into troubles. Make sure the terms and conditions are agreeable between both parties. If not, you could always voice out your opinions and discuss between both the landlord and tenant until you reach an agreeable tenancy agreement. 

In conclusion, it is always advised to be well prepared before getting your property leased out. Make sure you know your rights as a landlord to prevent getting into troubles. If needed, do not hesitate to engage with legal advices and seek for professional help.

SHOULD YOU INVEST IN COMMERCIAL PROPERTIES?

Are you planning to buy a commercial property in Malaysia but cannot decide if commercial property is a good investment plan? Real estate agents get asked whether a commercial or a residential property is a good investment plan. i) High returns on investments
The best reason to invest in commercial property over residential property is the higher income potential. Commercial property will normally have an annual return on investments between 6% and 12%. In addition, the price of commercial properties can increase by double in a short time (3 to 6 years) as compared to residential properties where it would normally take between 7 years to 10 years. This however, is large depending on the area of the property.

ii) Longer lease
Commercial tenancy will have a longer lease between 2 years and 10 years, whereas residential tenancy will turn over every 6 months to 12 months maximum, which is considered short as compared to a commercial tenancy. This is due to business commitment that the tenants have committed to as they spent a huge sum in renovating the shops for business purposes, hence, a longer lease.

iii) Well-maintained property
Renovation is needed to suit the business needs of the tenants, therefore, tenants will be spending a huge sum in renovating the shops to maintain the store image. After all, it is important to look presentable to attract the customers’ interests. Hence, the property owner and the commercial tenants will have their interests aligned: the owner will be able to maintain the property’s quality and the tenants will be able to attract more customers.

iv) Tenants
It is common to have tenants that are from large companies or corporations whereas the tenants for residential properties are typically individuals. With such big companies or large corporations, you can worry less on late rental payment as they are more reliable and tend to avoid the breaching of tenancy agreement.

v) Furnishing
Tenants for residential properties will normally request or prefer a fully furnished unit whereas tenants for commercial properties prefer an unfurnished unit because they tend to refurbish and decorate the unit accordingly. This will then save the owner a lot of furnishing and renovation costs.

      B)    Negative reasons to invest in commercial property
     
      i) Bigger capital
You will need to fork out a big initial capital as compared to residential property for 2 reasons: commercial properties are more expensive and lower loan financing from the bank. With bigger initial investment spent on a residential property, you can only the gain in revenue will outweigh the gain in cost.

ii) Higher outflow
The percentage of tenant quitting the rent will be higher than the tenant quitting the lease in a residential property. This is largely depending on the demand in rental yields. If the location of the commercial property is not located in a hotspot area, the risk will be even higher.

iii) Higher interest rate with stricter lending condition
Obtaining a commercial property loan is typically much harder than obtaining a loan for residential property. Even if you manage to secure a commercial property loan from the bank, the percentage of loan secured is much lower as compared to the loan obtained for residential properties where it can go as much as 90% loan financing. In addition, the interest rate of bank loan for commercial property is typically higher as compared to residential home loan.

iv) Commitment
Owning a commercial property will demand a longer time spent on management as you will be dealing with more tenants as compared to a residential property where you deal with lesser tenants. You will be dealing with multiple leases, maintenance issues, public safety and so on.

v) Risky
Commercial properties generally have more public visitors as it is intended for commercial use. Therefore, you risk getting damages on your property easier as there are many people in a commercial property as compared to a residential property. There are some risks that can happen unexpectedly such as car accidents, or spray paint on the buildings. These changes in infrastructure are unexpected and unavoidable. Besides, the rental yields depend solely on the supply demands. That being said, more populations will increase the number of tenants in a commercial property for business purpose. However, this is very unpredictable as there is a possibility of lesser rental yields that result in longer vacancy phase. Although commercial properties will have a longer lease of 2 years to 10 years, once the lease ends, it will take a longer time to find a tenant. That being said, you will then need to cover all cost on your own.

RESEPI IKAN GORENG SUMBAT SERAI SIMPLE | Hari ni busyra nak share resepi ikan goreng sumbat serai simple tapi sedapnya boleh tambah nasi 2 ke 3 kali. hehe. Betul ni serius. tak percaya, esok acik-acik, akak-akak try la masak.. Bahan-bahannya pun sangat mudah dan untuk bahan utama ikan tu tak kisahlah ye korang nak guna ikan apa pun asalkan ia sedap!

Bahan-bahan:

1. 4 ekor ikan kembung (belah belakang)
2. 1 biji bawang besar
3. 2 biji cili besar merah
4. 2 biji cili padi merah (kalau nak lagi pedas boleh tambah ikut selera sendiri)
5. 1 batang serai (dihiris halus)
6. Gula dan garam secukup rasa

Cara-caranya:

1. Tumbuk kasar semua bahan no 2 hingga no 4.
2. Kemudian bahan tumbuk tadi digaul dengan serai, gula dan garam

EDIT GAMBAR ADIK PILOT BERLATARKAN LAPANGAN TERBANG | Hai, jumpa lagi kita dalam rancangan hakak edit mengedit. haha. Dah nama nya pun hobi kan, so waktu-waktu yang terluang ni kita habiskan dengan bermain photoshop. Masih mengasah skill yang tak berapa nak tajam ni. Masih merangkak untuk mengenal basic mengedit gambar. Kali ni busyra edit gambar adik pilot berlatarkan lapangan terbangan.

Model budak kecik tu adalah anak buah busyra. Banyak sebenarnya gambar dia yang busyra snap. Tapi rasanya gambar ini yang sesuai untuk dipadankan dengan background lapangan terbang (gambar dari google).. 

Haritu ada yang tanya busyra.. "belajar dari mana photoshop ni?" ..busyra belajar semuanya dari youtube. Macam-macam teknik edit gambar dorang tunjuk. Hasil dorang edit gambar tu memang bommm lah! cantik dan perfect. Bila kita tengok hasil yang kita buat, rasa kerdil sangat. Sebab tu kena belajar lagi dan lagi. Harapnya korang tak jemu untuk tengok hasil design busyra dalam fasa pembelajaran ni.

3 CARA PENJAGAAN MUKA WAJIB DIBUAT SEBELUM TIDUR | Hai semua. Malam ni rasa nak share dengan korang 3 penjagaan muka wajib dibuat sebelum tidur.. Hari-hari tak kan miss melainkan busyra terlalu penat sampai tertidur tanpa bersihkan muka. Serius lepas bangun tidur tu rasa menyesal sangat kenapalah mata ni terlelap. huhu

Pertama, Busyra akan CUCI MUKA. Tipsnya korang kena sapu betul-betul pencuci muka yang korang guna.. paling tidak dalam 2-3 minit. Muka pun perlu dibelai tau. Apa ingat kucing je ke perlu belaian. haha. Kenapa lama sangat? Sebab nak biarkan segala kekotoran krim dan segala bagai alat makeup yang kita pakai tu remove dengan baik. Then bila nak bilas dengan air, pastikan bilas dengan sebetulnya. Jangan basuh main-main je tau.

Busyra ambil pengajaran dari adik busyra sendiri. Dulu masa dia baru berjinak-jinak nak pakai pencuci, dia basuh ala kadar saja.. Dari situ timbulnya blackhead. Trust me! Cucilah muka dengan sebersih-bersihnya. Then lap dengan tuala bersih. Guna cleanser dalam 2-3 kali saja sehari okay! Sebab lagi kerap kita gunakan cleanser lagi berminyak muka nanti. Lupa pula nak cakap busyra guna pencuci Nivea Pearl White. Boleh refer >> SINI

Kedua, Busyra akan apply PRIMER WATER. Macam mana rupanya? Korang boleh google sendiri. Banyak ja jenama primer water yang boleh digunakan. Textur dia macam air tapi pekat sikit. Busyra pakai jenama Althea, boleh baca >> SINI .Lepas sapu dan manjakan muka. Biarkan ia kering sendiri. Ia akan meresap dan menghidrat liang pori wajah kita. Serius segar rasa muka!

Ketiga, akhir sekali busyra akan sapukan Fixer Cream! Kalau nak tahu jenama apa yang busyra guna korang boleh baca di entri yang sama di point kedua tadi ye. Letak sikit saja krim dibahagian muka dan sapu, mengurut muka dari bawah bawa ke atas. Buat sebanyak 5 kali dan lebih. Biar krim tu meresap kedalam muka. Esok pagi bangun muka fresh sangat! Sekarang ni banyak saja brand yang best-best. Korang cari saja krim yang bersesuaian dengan muka korang. Jangan skip tiap-tiap malam kena buat. Pasti muka licin peloless. hehe.

Itu saja yang busyra nak kongsikan tentang penjagaan muka busyra setiap malam. Kalau bab scrub atau mask, busyra pakai juga tapi jarang-jarang. For me, apa yang penting, sebelum tidur ingat cuci muka, primer water, krim! 1 lagi paling penting doa tidur. Last sekali bummmm. zzzZZ. haha. Okay bai! Jumpa lagi.

JAGUNG REBUS CHEESE SEDAP! | Hai semua. Siapa sini peminat jagung? Jom try this resepi. Serius sedap dan tak manis sangat. Tapi bagi peminat cheese saja tau. Awas yang tak suka cheese anda tidak digalakkan mencuba! hehe. Senang sangat nak buat jagung rebus cheese!

Bahan-bahan:

1. Jagung
2. Kepingan Cheese
3. Marjerin
4. 1 sudu gula (nak ganti susu pun boleh)
5. Secubit garam (letak sikit saja sebab cheese dah rasa masin2)

Caranya:

1. Rebus jagung
2. Hiris jagung dan masukkan gula dan garam. Gaul.
3. Letak cheese di atas dan masukkan dalam microwave dalam 1 minit saja (untuk cairkan cheese). Akhir sekali, gaulkan semuanya supaya rata. Siap! marvelesss!
